Injuries associated with scaffolding and falling injuries

Over the last 20 years, we have advised lots of clients who have been injured when assembling or disassembling scaffolding, as well as falling off platforms, ladders and roofs near to scaffolding.

Some of the most common injuries we have seen associated with scaffolding accidents at work include:

    • Serious hand and finger crushing and fracture injuries
    • Severe shoulder injuries
    • Fractured wrist injuries
    • Fractured legs, hips and ankles
    • Very serious head and spinal injuries

If you or a loved one has been injured at work, in an accident involving scaffolding then you may be able to claim compensation against your employer if insufficient risk assessment was carried out and they breached their legal duty under the Work at Height regulations.

There are very strict time limits involved in work related scaffolding claims and falling outside of the claim window prevents you from being able to claim.

How to start a work related scaffolding accident claim

The very nature of serious scaffolding related accidents means that in lots of cases, there will be a period of time in which you are unable to work due to your injuries. In some serious cases, you may be signed off work for several months without pay.

After you have received medical treatment and been assessed by a doctor or specialist, we recommend that you contact a law firm to discuss where you stand legally regarding a claim for compensation.

How much compensation can I claim for a Scaffolding accident?

The amount of compensation you can expect to claim depends on the type and severity of your injury.

Every claim is different, however compensation awards for personal injury claims are based on a set of national guidelines called the Judicial College Guidelines. These guideline are published for the assessment of general damages in personal injury cases.

The latest set of guidelines (the 15th edition) were published at the end of 2019.  Guideline amounts for common work related scaffolding injuries are as follows:

    • Injuries that have caused fingers to be severely fractured and lead to loss of dexterity and impairment of grip – up to £31,350
    • Serious injuries that leads to loss of function in one or both hands – £52,310 to £79,360
    • Severe shoulder injuries, resulting in significant disability – £12,600 to £31,500
    • Serious wrist injuries, such as a fracture, that leads to permanent ongoing pain or problematic symptoms – £11,280 to £22,990

In addition to compensation for pain and suffering, we are also able to help you claim for “special damages”.

These damages include any loss of past and future earnings, your pensions and medical care. Special damages often make up a very large percentage of the total claim value and in some circumstances can amount to millions of pounds.
