Were you exposed to Asbestos at work?

The use of asbestos in the UK was common throughout the 1950’s until it was banned in the mid 1990’s. Due to its good heat and fire resistant properties, it was widely used in construction, plumbing, shipbuilding and manufacturing.

Millions of the UK workforce were exposed to asbestos and unknowingly, put at danger of developing serious medical conditions later in life.

Over the past 20 years, our solicitors have represented many clients in successful claims and helped to recover millions of pounds worth on compensation on their behalf.

We recommend that if you were exposed to asbestos during your working career and have subsequently been diagnosed with asbestos lung cancer, asbestosis, pleural thickening or mesothelioma to contact us as soon as possible.

It does not matter that you were exposed to asbestos a long time ago, if you have been diagnosed with asbestosis in the past 3 years, our expert solicitors can advise you on a claim for asbestos lung cancer.

How to start a new claim for asbestos lung cancer

Every new claim for asbestos lung cancer starts with an initial telephone call.

We understand that the claims process may seem daunting and lots of our clients tell us how difficult it was to make that first call to us, for fear of the unknown but we’re here to help you, every step of the way and aim to make the process of claiming compensation as stress free as possible for you.

    Free initial phone consultation

We offer all new clients a free and no obligation initial consultation, during which we will take details from you relating to your working career, exposure to asbestos and your current symptoms.

Our friendly solicitors will ask you a series of questions to help us understand how the diagnosis and your symptoms have affected you and your family.

We will also request to see your hospital or GP records, which we will obtain on your behalf once you have given us permission to do so. This medical information will help us establish whether we can assist you with a No Win No Fee claim.

Once we have built a clear picture of your personal circumstances, we will be able to advise you on whether we believe your potential claim has good prospects of success.

How much does it cost to make a claim?

No upfront fees are required to get a new claim up and running.

We use Conditional Fee Agreements to fund our asbestos lung cancer claims. These agreements are also commonly referred to as either a “CFA” or a “No Win No Fee agreement”.

The nature of these agreements means that law firms take all the financial risk and not the client.  If a claim fails, the law firm is not paid and the client does not have to pay any solicitor’s fees for their time.  For taking this risk, it is common for law firms to agree with a client that they will be paid up to 25% of the client’s compensation at the end of a successful claim.

Law firms fees are mostly paid by the insurers of the losing party.

What if an employer no longer exists?

This is one of the most common queries we receive from new clients, who believe it is no longer possible to start a claim if an old employer has closed or was taken over many years ago.

Our solicitors are very experienced and are often able to trace the employer’s liability insurance of dormant or closed companies.

Do not let this point deter you from contacting us, we still may be able to assist you.

How long do asbestos claims take from start to finish?

All asbestos lung cancer claims are different but ordinarily claims can take up to 24 months to settle.

Unfortunately and very sadly, in some cases the person suffering from the asbestos related disease does not survive to see the conclusion of their claim. Where this happens, our supportive solicitors are able to assist the family with the Coroner’s investigations, including supplying the Coroner with details of work history and exposure to asbestos.

In cases such as these, there is nothing that we can do to lessen the grief and upset caused by losing a loved one but when the family feel that they are ready, our specialist asbestos solicitors are able to continue the claim on behalf of the next of kin, to ensure that compensation is obtained and justice is gained.

    Compensation amounts for Asbestos disease

The actual amount of compensation you could expect to receive for the pain and suffering caused by your asbestos condition are based on a set of national guidelines and fall into bands.

The figures below are based on figures published in the 15th edition of the Judicial College Guidelines for the assessment of damages in personal injury cases, which was published in 2019.

    • Asbestosis – £12,000 – £90,000
    • Asbestos Lung Cancer – £59,000 – £91,000
    • Mesothelioma – £59,000 – £118,000
    • Pleural Thickening – £12,000 – £90,000

In addition to damages for pain and suffering, our asbestos claim solicitors are also able to claim for special damages, which include loss of earnings claims (past and future) and medical care. These special damages often make up a large percentage of the total claim value, which in some cases are valued at several million pounds.

Every asbestos lung cancer claim is different and with so many legal complexities to consider, it is vital that you instruct a firm of solicitors who have the necessary expertise and experience to deal with your claim.
