The Claimant developed frostbite on his feet when serving in the British Army in Canada. He was not provided with adequate footwear, which resulted in his being exposed to cold and wet conditions for prolonged periods of time.

As a result of his injury, he was discharged from service and became unemployed.

Subsequently, he commenced a civil claim for damages for pain and suffering, and loss of income, pension and prospects of promotion to a higher military rank.

The claim settled out of court in the sum of £635,000.
