Motorcycle Accident Solicitors – Just how dangerous are motorcycle accidents?

Road accidents involving motorcyclists are often serious and are regularly caused by the carelessness of other road users.  Our Lincolnshire based motorcycle accident solicitors are able to advise you or a loved one on a claim for compensation.

Our latest blog post looks at motorcycle accident figures for 2018, recently published by the government.

Motorcycle Accident Statistics

Latest figures produced by the department for Transport for accidents in 2018 show that there were 17,890 motorcycle accidents, of which 5,877 were classified as motorcyclists having sustained “serious injuries”. This figure is exceptionally high and represents some 32.85% of all motorcycle accidents, which means 1 in 3 motorcyclists involved in an accident were seriously injured.

An even more alarming statistic is that 389 motorcyclists were involved in fatal accidents, which translates into a motorcycle fatality every 45 motorcycle accidents in the UK during 2018.

When you compare motorcycle accident statistics with car accidents during the same period, it is clear that motorcyclists are involved in a far greater percentage of serious and fatal accidents than car drivers.

Of 165,000 car accidents during 2018, 26,029 were reported to have involved serious injury, where either the driver or passenger required urgent medical attention.

This car accident data means that 15.75% of all car accidents in 2018 were of a very serious nature, compared to over 32.85% of motorcycle accidents during the same period.

Motorcyclists beware on Lincolnshire’s roads

Motorcyclists on Lincolnshire’s roads should also take extra care, our roads are unfortunately some of the most dangerous in the entire country.

The roads around Lincoln, Skegness, Market Rasen, Sleaford, Louth and Scunthorpe are renowned as being some of the most dangerous in the county, with the A15, A16, A17 and the A46 being particular accident hotspots for both motorcycle and car accidents.

Military Hearing Loss Claim for £545,000

UK Military

A former Royal Marine has been awarded over £545,000 in compensation from the Ministry of Defence (MoD) in relation to military hearing loss claim as a result of exposure to excessive noise.

The Marine had originally been claiming over £1.25 million, in what was seen by many as a landmark case.

The former Marine claimed that his military hearing loss had been caused by his prolonged exposure to noise from thousands of rounds of ammunition, helicopters and aircraft and a range of weapons during his 14 years of service.  He claimed that he was not given the correct hearing protection during his service and is now required to wear hearing aids for the rest of his life. He also intended to work his entire career within the military, however, he was medically discharged and his time in the military was cut short due to his damaged hearing.

Latest Government figures show that military related claims for hearing loss are now the most common type of claim against the MoD for financial compensation.

Are you worried your hearing has been damaged in the military?

The military solicitors at Nigel Askew Solicitors have noticed a considerable increase in the number of military personnel enquiring about military hearing loss claims over the last 12 months.

Some of the most common sources of noise which feature in many of the enquiries we have received over the past 12 months include:

  • Firing weapons during training exercises
  • Working around military vehicle engines
  • Aircraft and helicopter noise
  • Explosions in training scenarios
  • Mortars

If you were exposed to excessive noise during the course of your employment in the Armed Forces and were not provided with any or sufficient hearing protection then you may be entitled to make a claim for military hearing loss.

We are able to advise all members of the Armed Forces, including Army, RAF, Navy, Marines and Special Forces personnel.

UK Military Compensation Solicitors – don’t settle for less

If you are thinking about making a civil claim for compensation for injuries or illness suffered in the military, it is vital you consider all of the options available to you before deciding on whether to pursue a claim via the Armed Forces Compensation Scheme (AFCS) or through a civil claim for compensation via UK military compensation solicitors.

As expert UK military compensation solicitors, we believe it’s important you speak to solicitors with experience in military claims, who are able to provide you with an experienced opinion on which route may be the best for you, before making a decision on how you will proceed with a claim.

Do not settle for less

The government has recently launched a website called Veterans UK, which is part of the Ministry of Defence (MoD). They claim to offer veterans free helpline support and access to compensation via the AFCS.

Many industry experts believe that the MoD are not providing veterans with all of the information available to them regarding time limits in civil claims, which is subsequently leading to many missing out on valuable compensation which they may have been due.

Below, we briefly discuss the advantages and disadvantages of claiming via the AFCS.

What is the Armed Forces Compensation Scheme?

The AFCS is a statutory scheme for those in the armed forces who sustained an illness or injury whilst serving in the armed forces.

This scheme is for all sections of the armed forces, including the Reserve Forces.

To qualify, you must be a current or former member of the armed forces, the injury must have been sustained after April 6 2005, and the claim must be brought with 7 years of the injury.

What can you claim for?

The main advantage of the AFCS is that it is a no fault compensation scheme, meaning you do not have to prove the MoD was negligent.

You can claim for any type of illness or injury sustained as a result of service.

A claim can also be brought for service-related activity, such as adventurous training, physical exercise and sports activities organised by the forces.

The armed forces have a tariff scheme which ranges from £1,200 and £650,000 for successful claims.

The upper limit is capped, whereas there is no cap via a civil claim for compensation.

You may also receive a tax free payment for life if the injury results in your discharge and your employment is affected. This will be calculated on your pay and age.

So, why bother bringing a civil claim?

In a civil claim for compensation, you can claim for damages, both for the actual injury, and for other losses, such as loss of earnings.  This element of the claim is often extremely valuable, especially in cases involving clients being discharged on medical grounds.  A client therefore must consider their earning capability in civilian life with their current injuries, compared to their earning potential in the military in full health.

The difference in these figures is often very large and can be claimed for.

Do not settle for less – always consider a civil claim

Claims brought via the AFCS do not factor in damages or loss of earnings.

Claims brought via the AFCS can also be denied, often leaving veterans and families wondering where to turn next.

As expert solicitors in the field of military claims, we advise all clients to seek independent legal advice before deciding on which type of claim is best for their personal circumstances.

Road accident in Lincolnshire – How to cope

Road accident in Lincolnshire

According to the department of transport, more than 160,000 people were injured in road accidents in 2018, with 20% of those people sustaining serious injuries.  Lincolnshire ranked second only to Kent in the total number of serious or fatal road accidents during this time.

The roads around Lincoln, Skegness, Market Rasen, Sleaford, Boston, Louth and Scunthorpe are renowned as being some of the most dangerous in the county, with the A15, A16, A17 and the A46 being particular accident hotspots.

Road accidents can be devastating

The effects of a personal injury in a road accident can be devastating and in some cases, life-changing.  It’s not always obvious where to turn after a road accident, especially if you have sustained a serious injury as result.  Nigel Askew Solicitors have many years experience in helping clients who have been injured in road accidents in Lincolnshire and across the UK.

Here we talk about some of the options available to people who have been involved in road accidents and how to cope with the aftermath.

Local support groups

Support groups like Road Peace offer accident victims and their families support after serious accidents and road deaths.  They offer emotional support, reassurance and practical guidance to all those affected.

There are also many local support groups that can be found via Facebook, which arrange regular face to face meetings to help accident victims and their families cope and offer lots of practical advice.

Physiotherapy

There are many benefits to physiotherapy which include restoring movement and function to someone affected by injury, illness or disability.  Physio can also help prevent further damage or injury on the previously affected area of the body.

Not all road accident victims benefit from physiotherapy and it’s always a good idea to speak with your GP or medical professional before starting any physio to ensure it is right for you.

Post-traumatic stress disorder (PTSD)

According to recent studies, over 10% of all Road Accident victims develop varying degrees of PTSD associated with their car accident.  The feelings of anxiety for both drivers and passengers after a serious accident may last up to 12 months and cause a number of other symptoms including loss of sleep, nervousness and irritability.

There are several treatments available for PTSD which can help alleviate some of the symptoms, which include cognitive behavioural therapy, yoga and massage. Always seek professional help if you believe you are suffering from PTSD as a result of a recent road accident in Lincolnshire.
