How much does it cost to claim?
We do not require our clients to pay us any upfront fees.
Instead, we offer our services by using Conditional Fee Agreements. These agreements are commonly referred to as either a “CFA” or a “No Win No Fee agreement”.
The nature of these agreements means that law firms shoulder the financial risk and not the client. If a claim fails, the law firm is not paid and the client does not have to pay any solicitor’s fees for their time. For taking this risk, it is common for law firms to agree with a client that they will be paid a % of the client’s compensation award at the end of a successful claim.
Our basic fees are paid by the insurers of the negligent party, which commonly with asbestos related claims is your previous employer’s liability insurance policy.
But my employer doesn’t exist!
You may be wondering how we can make a claim against your employers if they no longer exist or were taken over 30, 40 or 50 years ago?
Do not worry if your employer is no longer trading, our solicitors have many years of experience in tracing employer’s liability insurers of dormant or closed companies. This means that despite your old employer closing or being taken over, you still may be able to claim.
Contact us today by calling 01507 609027 to discuss your specific claim details.
I was exposed to asbestos many years ago, can I still claim?
Yes, despite your exposure to asbestos being 30, 40 or 50 years ago, if you have been diagnosed with an asbestos related disease within the last 3 years then we can advise you on a potential claim.
There is a strict 3 year limitation period in England & Wales, which starts from either the day you were officially diagnosed by a consultant or specialist or from the date you first linked your symptoms to your work and your exposure to asbestos.
If you are unsure if you can claim, call Nigel Askew Solicitors now on 01507 609027.
Compensation amounts for asbestos claims
The actual amount of compensation you could expect to receive for the pain and suffering caused by your injuries are based on a set of national guidelines and fall into bands.
The figures below are based on figures published in the 15th edition of the Judicial College Guidelines for the assessment of damages in personal injury cases, which was published in 2019.
- Asbestosis – £12,000 – £90,000
- Asbestos Lung Cancer – £59,000 – £91,000
- Mesothelioma – £59,000 – £118,000
- Pleural Thickening – £12,000 – £90,000
In addition to damages for pain and suffering, our asbestos claim solicitors are also able to claim for special damages, which include loss of earnings claims (past and future) and medical care. These special damages often make up a large percentage of the total claim value, which in some cases are valued at several million pounds.
Every asbestos claim for compensation is different and with so many legal complexities to consider, it is vital that you instruct a firm of solicitors who have the necessary expertise and experience to deal with your claim.
